Terms of Service
Tyne operates a sample-first marketplace for consumer packaged goods (CPG) packaging at trytyne.com. Brands and founders (“Buyers”) browse packaging from vetted manufacturers and distributors (“Suppliers”), order low-cost physical samples and curated launch kits shipped from U.S. stock, request customized samples, and move to bulk purchases through a quote-first process. By creating an account, placing an order, submitting a request, listing products, or otherwise using the services, you agree to these Terms. If you do not agree, do not use the services.
1.The Marketplace
Tyne curates and displays packaging products supplied by third-party Suppliers. For sample orders and launch kits, Tyne is your seller of record: we stock Supplier samples in the United States, process your payment, and ship to you. For bulk orders, Tyne arranges the transaction between you and the Supplier under a written quote (Section 5). Tyne reviews Suppliers and listings before they go live, but we do not manufacture the products and do not guarantee that any product is fit for your specific application; you are responsible for validating packaging against your product, filling process, and regulatory requirements before ordering in bulk.
2.Accounts
Buyer accounts use passwordless email sign-in links and, optionally, Google sign-in. You agree to provide accurate, current information (including your shipping address and company details) and keep it updated. You are responsible for activity under your account and for the security of your email inbox, since it controls sign-in. The services are intended for business use by people 18 or older.
3.Samples & Launch Kits
Sample and kit prices are shown at checkout (currently $2.99 per sample and flat-priced kits, subject to change). Sample orders are currently capped at 20 units per order, including the contents of any launch kit; we may change or waive caps at any time. Samples ship to U.S. addresses only. Shipping cost is calculated at checkout from live carrier rates and billed to you. Quoted transit and handling times (including “1-3 business days”) are good-faith targets, not guarantees. We may refuse, cancel, or limit any order before shipment for any reason, with a refund of amounts paid for the cancelled items as your sole remedy. Because samples are low-cost physical goods shipped on demand, sample and kit orders are final once shipped; if a sample arrives damaged, defective, or incorrect, contact us within 7 days and we will, at our choice, replace it or refund it.
Samples and kits are sold for evaluation only: checking fit, finish, print quality, and material feel before you place a bulk order. They may not be resold, filled for retail sale, or sent to end customers; only products purchased through a bulk order and fulfilled by the Supplier may be filled, sold, or distributed commercially. SAMPLES ARE NOT CERTIFIED OR WARRANTED FOR PRODUCTION OR FOOD-CONTACT USE (compliance documentation, such as a food-contact letter of guaranty, attaches to bulk orders only), and any commercial use of a sample is at your own risk and voids any related warranty or liability on our part or the Supplier's.
4.Sample Credit
100% of what you paid for sample and kit products is credited toward your matching bulk order with Tyne. Shipping charges and taxes are not credited. Credit from one sample order applies to one bulk order: each bulk order may redeem the credit of a single sample order, credits from multiple sample orders do not stack on one bulk order, and each sample order's credit may be redeemed once. Sample credit is a promotional credit, not stored value: it is applied at payment, has no cash value, is not transferable or redeemable for money, and applies only to bulk orders placed through Tyne. Credits already earned remain usable for 12 months from the order that earned them, then expire. We may modify, suspend, or end the sample credit program at any time, and may correct credit balances in cases of refunds, chargebacks, or error.
5.Bulk Orders & Quotes
Bulk purchases are quote-first: you submit a request (quantity, customization details, artwork if any) and we confirm unit pricing, freight, lead time, and any applicable discount with the Supplier before presenting a written quote in your account. A quote is an offer that you accept by paying it before its stated expiration; once paid, it is a binding order. Quoted lead times are estimates. Reorder discounts, when offered, are applied at Tyne’s discretion and reflected on your quote. Bulk orders are subject to the Supplier’s minimum order quantity (MOQ) shown on the listing.
6.Customization & Your Artwork
When you upload artwork or branding for customized samples or bulk production, you represent that you own or are licensed to use it, and you grant Tyne and the relevant Supplier a limited license to reproduce it to fulfill your request, and to retain copies as part of our order records, for quality control, and to defend or resolve disputes. We will not use your artwork to promote Tyne without your consent. You are solely responsible for the legal compliance of your artwork and product claims.
7.Payments
Payments are processed by Stripe; Tyne does not store your full card details. Prices are in U.S. dollars. You are responsible for applicable taxes. You agree to contact us before initiating a chargeback. If a payment is disputed or reversed, we may suspend your account, cancel unshipped orders, and reverse any associated sample credit; if a chargeback is resolved in our favor, you will reimburse the associated processing fees, and we may require prepayment by other means for future orders.
8.Suppliers
Suppliers list products through Tyne’s onboarding and agree to supplemental supplier terms presented during onboarding. In summary: listings go live only after Tyne review; Suppliers provide sample units to Tyne, and those units become Tyne’s own inventory, so Tyne is the owner and seller of the samples and kits you buy; Suppliers must provide accurate product data, honor quoted bulk pricing and lead times they confirm, and comply with all applicable laws, including the INFORM Consumers Act (we collect and verify bank, tax, and contact information from high-volume sellers and suspend those who do not comply). Tyne may reject, edit for accuracy, suspend, or remove any listing or Supplier at its discretion.
9.Prohibited Items & Uses
The marketplace may not be used for products or conduct that is illegal, counterfeit, or infringing. Suppliers may not list, and Buyers may not request, items that are hazardous, regulated without proper licensure, or misrepresented. You may not scrape the catalog, interfere with the services, misuse promotional pricing or credits, or attempt to transact around the marketplace with a counterparty you met through it in order to avoid fees on a Tyne-originated bulk order.
10.Intellectual Property
The Tyne name, site, catalog structure, photography we produce, and software are owned by Canary Street LLC or its licensors. Product trademarks belong to their respective Suppliers. You may not copy or reuse marketplace content except as needed to evaluate and purchase products.
11.Disclaimer of Warranties
The services and all products are provided “as is” and “as available,” without warranties of any kind, express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Tyne does not warrant uninterrupted or error-free service, that catalog data (including pricing tiers, capacities, and lead times) is free of inaccuracies, or that any delivery target will be met. Product specifications should be confirmed on your quote before bulk purchase.
12.Limitation of Liability
To the maximum extent permitted by law, Tyne will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for lost profits, lost sales, or lost business, even if advised of the possibility. Tyne’s total aggregate liability for all claims arising out of or related to the services or these Terms will not exceed the greater of (a) the amounts you paid to Tyne in the three (3) months before the event giving rise to the claim, or (b) US $100.
13.Indemnification
You agree to defend, indemnify, and hold harmless Canary Street LLC (d/b/a Tyne), its members, officers, employees, and agents from claims, damages, losses, liabilities, fines, and expenses (including reasonable attorneys’ fees) arising out of your products, your artwork, your use of purchased packaging, your breach of these Terms, or your violation of law.
14.Term & Termination
These Terms apply while you use the services. You may stop using the services or ask us to close your account at any time. Tyne may suspend or terminate access, or cancel unfulfilled orders with a refund of amounts paid for them, with or without cause, on notice. Sections that by their nature should survive (including 4, 6, 10-13, and 16) survive termination.
15.Changes to the Terms
We may update these Terms from time to time. Material changes will be posted here with a new effective date and, where practical, sent to your account email. Continued use after changes take effect constitutes acceptance.
16.Governing Law & Disputes
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws rules. The exclusive venue for any dispute is the state or federal courts located in Pinellas County, Florida, and you consent to their personal jurisdiction. Both parties waive any right to bring or participate in a class or representative action against the other; disputes may be brought only in each party's individual capacity. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
17.Miscellaneous
These Terms (together with any supplier agreement you sign during onboarding) are the entire agreement between you and Tyne regarding the services. If any provision is held unenforceable, the rest remains in effect; failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them freely. Neither party is liable for delays or failures caused by events beyond its reasonable control. Notices may be sent to your account email.
